Chief Justice John Roberts rebukes Trump over ‘Obama judge’ comment

US Chief Justice John Roberts defended the independence of the federal judiciary on Wednesday a day after President Donald Trump called a judge who ruled against his policy barring asylum for certain immigrants an "Obama judge", but Trump rejected the rebuke, chided Roberts and launched a new round of attacks.

The spectacle of the ostensibly nonpolitical chief justice engaged in a dispute with the president of the United States is insulting to the Supreme Court and to our system of justice.

"That independent judiciary is something we should all be thankful for", the chief justice added in the brief statement released on the eve of the Thanksgiving holiday.

The president's remarks that spurred Roberts to speak out came Tuesday, when Trump, talking to White House reporters, responded to a question about Tigar's ruling against the president's plan to quit accepting asylum claims of migrants at the southern border. "And I'll tell you what, it's not going to happen like this anymore", said Mr Trump of Judge Tigar's ruling.

In 2010, President Obama used his first State of the Union address to denounce the Court's January 2010 ruling in the Citizens United case, which struck down restrictions on corporate political speech under the First Amendment.

There is, of course, absolutely no reason to think the 9th Circuit is making the country less safe, whereas Trump's own policies have cruelly traumatized thousands of children. "Very risky and unwise!" the president said. "Everybody that wants to sue the USA -almost-they file their case in the Ninth Circuit, and it means an automatic loss.

I suspect at some point Roberts decided enough was enough and he had to say something", Somin added.

Tigar ruled on Monday that Trump could not rewrite immigration laws that allow all immigrants to assert asylum claims. In 2016, candidate Trump blasted Judge Gonzalo Curiel who was presiding over a lawsuit against Trump University.

The Department of Justice called the ruling "absurd" and vowed to appeal it before the 9th Circuit.

Chief Justice Roberts' Supreme Court colleague Ruth Bader Ginsburg has been a far more outspoken critic of Mr Trump.

Judge Tigar was appointed by Democrat Barack Obama.

The court has long had a majority of judges appointed by Democratic presidents, with the current breakdown at 16-7.

In challenging a co-equal branch of government, Trump complains that his opponents file lawsuits in courts that are part of the liberal-leaning 9th U.S. Circuit Court of Appeals.

When the history of this dark era is written, our independent judiciary (& free press) will be the heroes". Indeed, when then-Supreme Court nominee Neil Gorsuch privately told senators that such attacks are not good for the morale of the federal judiciary, Trump was reported to have considered pulling the nomination. "The opinion of this so-called judge, which essentially takes law-enforcement away from our country, is ridiculous and will be overturned!" the president tweeted last December.

The Robert Mueller probe is really the only flank where Donald Trump has not been officially swatted down in the last few weeks of non-stop embarrasments for the U.S. president starting with the Democratic takeover of the House of representaitives in what is undeniably a blue wave in the US.
