Ex-Trump aide Flynn does not deserve jail, lawyers say

Some democrats are calling for impeachment as they take over the House and Trump's former lawyer Michael Cohen is sentenced.

This comes after a sentencing memo filed by Flynn's defense team on Tuesday showed that Former FBI deputy director Andrew McCabe suggested that then-national security adviser Flynn not have a lawyer present for his interview with two bureau agents at the White House on January 24, 2017. As described in the Addendum, shortly after the SCO reached out to the defendant to seek his cooperation, the defendant accepted responsibility for his unlawful conduct and began cooperating with the government.

"I explained that I thought the quickest way to get this done was to have a conversation between [Flynn] and the agents only", McCabe wrote in a January 24, 2017, memo cited by Flynn's memo.

Flynn held the White House job for only 24 days.

Lt. Gen. Michael Flynn is requesting no more than a year of probation and community service for his confessed crime of lying to the Federal Bureau of Investigation, according to his sentencing memorandum filed December 11. Comey said this week the Russian Federation investigation was in its early stages, so he made a decision to send the agents to speak with Flynn in a low-key manner. Strzok was sacked in August.

Mueller's office has said that Flynn has had 19 meetings with investigators; enough to make him entitled to avoid prison when he is sentenced next week.

Separately, prosecutors announced Wednesday that they filled in another piece of the puzzle in the hush-money case: The parent company of the National Enquirer acknowledged making one of those payments "in concert" with the Trump campaign to protect him from a story that could have hurt his candidacy. "I assume he would know what he's doing", Trump said.

It is true that U.S. District Judge Emmet Sullivan has asked for documents related to quotations included in a sentencing memo from Flynn's defense team.

The special counsel's office did not give a sentence recommendation but said Cohen had cooperated with its inquiries.

Citing government records and "interviews with individuals familiar with the matter", Vox reported that the former Trump campaign chairman was providing this advice while both he and the White House knew Manafort was personally under FBI investigation.

Although descriptions of his cooperation with Mueller's team are redacted, they acknowledge Flynn assisted government investigators on a "range of issues, including interactions between individuals in the Presidential Transition Team and Russian Federation".

In a court filing before his Dec 18 sentencing in Washington, the lawyers asked that he be sentenced to a maximum of one year on probation, with minimal supervision conditions along with 200 hours of community service.
