UK’s court-ordered abortion ruling is overturned

Man holds a sign at the March for Life in London, England, May 11, 2019.

Press Association reports said that the triumvirate of judges that overruled Lieven's decision stated that the case was "unique" and they would explain their decision later.

Just days after a British judge ruled a mentally disabled woman must undergo an abortion, a three-judge panel in the English Court of Appeal overturned her decision.

Pro-life groups have welcomed the decision of the Court of Appeal overturning a mandatory abortion for a woman with a "moderately severe" learning disorder.

London's Court of Protection, which deals with cases involving individuals with reduced mental capacity, has heard that the woman wants to keep the baby.

She acknowledged a court-ordered abortion where the woman doesn't seem to want it "is an huge intrusion", but added she was ruling in the woman's "best interests, not on society's views of termination".

Lawyers who represented the woman's daughter also said she should be allowed to give birth.

It is critical to note the fact that this pregnant Catholic woman and her mother oppose the ruling.

Jacob Rees-Mogg, MP for North-East Somerset, told CNA that "This is deeply troubling but there is no Parliamentary route to challenging this decision". The woman is under the care of a National Health Service (NHS) trust, which is understood to have launched the case against the woman who reportedly originated from Nigeria. In one 2017 case, she compared Northern Ireland's restrictive abortion laws to torture and discrimination.

Notwithstanding our Nation's special relationship with the United Kingdom, the United States should assist this pregnant woman if she, or her mother, seeks a humanitarian alternative to this judicially-mandated forced late-term abortion.

The judge, Justice Nathalie Lieven, who serves in the Court of Protection, which deals with individuals deemed to lack the ability to make decisions for themselves, stated, "I am acutely conscious of the fact that for the State to order a woman to have a termination where it appears that she doesn't want it is an enormous intrusion".

"I have to operate in [her] best interests, not on society's views of termination".

"I think she would like to have a baby in the same way she would like to have a nice doll", the judge said.

But her mother - who was against abortion - said she could care for the child.

But the judge said the woman didn't have the mental capacity to make her own decisions even it look like she wanted to continue the pregnancy.

John Sherrington, a bishop in the Catholic diocese of Westminster, had branded the original ruling, made by the Court of Protection, "sad and distressing".
