Federal judge blocks rule limiting asylum claims by Central Americans

A federal judge temporarily blocked President Donald Trump's plan to deny most asylum claims at the U.S. -Mexico border, dealing a major blow to the administration's latest attempt to deter migration to the U.S.

Kelly says the immigrant advocacy groups that sued didn't prove that their work would be "irreparably harmed" if the policy went into effect.

Tigar, an Obama appointee, halted another version of the Trump administration's asylum restrictions past year.

White House press secretary Stephanie Grisham called the ruling a "victory".

Following the action by the San Francisco court, the rule will now be suspended pending further proceedings.

However, the administration officials, who has often railed against "loopholes" in the US asylum system, have strongly defended the rule, casting it as much-needed move for the government to deal with the months-long surge of Central America families heading towards the southern border and to fend off meritless claims from economic migrants.

President Donald Trump and his administration said the changes were meant to curb the number of migrants who are detained at the border, as widespread outrage over the conditions at immigrant detention facilities continues to mount.

The dueling rulings all but guarantee the question over restricting asylum claims would be appealed and possibly wind up before the Supreme Court.

The new policy denies asylum to anyone who passes through another country on the way to the USA without seeking protection there.

"If we only enforce our immigration laws at the border and fail to provide adequate resources to ensure those who have entered illegally proceed through the immigration process and, if ordered removed, are actually removed, the entire system will break down", he states, according to his prepared remarks.

The American Civil Liberties Union, Southern Poverty Law Center and the Center for Constitutional Rights also challenged the rule, saying it breaks worldwide law regarding asylum.

A motion hearing on the rule is also scheduled to take place later today before a federal judge in the Northern District Court of California.

Following the agreement, the Mexican foreign minister said migrant apprehensions have significantly dropped over the last month.

The policy has exceptions that would still allow a migrant to apply for US asylum: If someone has been trafficked, if an asylum seeker sought protection in a country but was denied or if the country the migrant passed through did not sign one of the major worldwide treaties that govern how refugees are managed - though most Western countries have signed them.

Top US officials say their latest plan would discourage migrants from leaving their countries, which is necessary to reduce the numbers of people that US border agents are detaining.

'The administrative record about the dangers faced by persons transiting through Mexico and the inadequacy of the asylum system there.is stunning, ' Tigar said from bench.

The Trump administration has issued a rapid-fire series of anti-immigration edicts recently.

"The Trump administration is trying to unilaterally reverse our country's legal and moral commitment to protect those fleeing danger", said Lee Gelernt, deputy director of the Immigrants' Rights Project of the ACLU in a statement last week.

Democrats have blasted the policies as cruel, faulting the Trump administration for warehousing migrants in crowded detention facilities along the border and separating immigrant children from the adults they have traveled with.
