Angelina Jolie and Brad Pitt's separation case has taken a fresh out of the plastic new turn.

Under California guideline exclusion is required as long as somebody aware of the realities "would perhaps respectably engage an uncertainty" around Judge Ouderkirk's cap potential to remain fair-minded, the submitting said.

Brad's legal counsel also mentioned that the mother-of-six "has never objected to [Ouderkirk's] continued involvement in this proceeding until now".

"Jolie's abrupt cry of judicial bias reeks of bad faith and desperation, not to mention careless disregard for the procedural rules meant to root out legitimately conflicted judicial officers", Pitt's lawyers said in the documents. According to People, Ouderkirk has 10 days to respond to the actress's filing.

'One can only conclude that this is an attempt to obstruct or influence Judge Ouderkirk's answer. Any delay in these proceedings is due to their zealous attempt.

Jolie's lawyer. Samantha Bley DeJean, responded to Pitt's filing in a statement to PEOPLE saying: 'This is the Judge who married them, someone who her team knew well and who her team actually introduced to the couple'.
