Republicans blocked former President Barack Obama's appointment to the court in 2016, saying it wasn't proper to make such an appointment during an election year. The topic of who should be appointed to the Supreme Court has been a point of heated debate among the political parties. The Senate's role is to advise and consent on the president's nominations. In her dissent to the court's 2013 decision gutting the Voting Rights Act of 1965, Justice Ginsberg noted that race-based voting discrimination still exists.

In recent years, several states, including IL and NY, have passed laws created to protect abortion rights regardless of potential changes to Supreme Court precedent.

Ms. Collins voted to confirm Justice Kavanaugh in 2018 and explained that he had "emphatically said no" when she asked him in private whether long-established precedents, including the right to obtain an abortion recognized in Roe v. Wade, should be overturned by five of the current justices. Most of the cases I write about in the book were decided by just one vote. If the election results are challenged, a four-four court can't decide anything.

"Our biggest enemy, obviously, is what we were talking about at the beginning of the interview - the coronavirus, keeping everybody healthy and well and in place to do our job", he said.
