According to Michigan GOP Rep. Paul Mitchell, who said he spoke days ago with Norman Shinkle, one of the two GOP members on the board, Shinkle indicated last week he would vote against certifying the election results until an investigation is completed so as to push a delay even though there is no evidence of fraud or malfeasance that would necessitate such a move.

The state board is made up of two Republicans and two Democrats and it is scheduled to meet Monday to certify the results.

"Having lost the vote in MI and other states that are necessary for a majority of the electoral college, President Trump and the Donald J. Trump For President, Inc".

Numerous votes that helped put Biden in the lead for good came from Wayne County, Michigan, where the city of Detroit is located.

Democrat Benson said no credible fraud charges had been filed in the state to justify the Canvasser Board's delay in certification.

The two Democrats are Jeannette Bradshaw, recording secretary of the International Brotherhood of Electrical Workers Local 58, and Macomb County Commissioner Julie Matuzak, former political director of the American Federation of Teachers. After the meeting, the two state legislators said they "have not yet been made aware of any information that would change the outcome of the election in MI".

They also said, "Michigan's certification process should be a deliberate process free from threats and intimidation".

Brewer took part in a panel hosted by the ACLU, the Detroit Branch of the NCAAP, and the League of Women Voters alongside other election law experts on November 19.

In the case of a deadlocked vote or failure to certify, Liedel says there is no role for the state Legislature to appoint electors, citing the state's separation of powers clause.

Numerous actions can be taken if the canvassers fail to exercise their duty, according to Steven Liedel, former chief legal counsel to former Gov. Jennifer Granholm.

"If there were to be a 2-2 split on the Board of State Canvassers it would then go to the Michigan Supreme Court to determine what their response would be, what their order would be".

Brewer adds, "Those sanctions have been used in the past against recalcitrant board members: contempt, possible bar grievances, and all the other penalties".

The states get a varying number of votes, equivalent to the number of their representatives in the US Congress - the House and the Senate. "There's nothing for them to wait for on Monday", says Brewer. "Campaign are engaged in a campaign to overturn the results of the election by blocking certification of the results, on the (legally incorrect) theory that blocking certification would allow state legislatures to override the will of the voters and choose the Trump Campaign's slate of electors".
