Vice President Mike Pence can overrule the Electoral College and effectively decide the 2020 presidential election himself, according to a lawsuit filed by Texas Republican Rep. Louie Gohmert, which Pence is fighting.

The lawsuit concerns Pence's role as president of the Senate. Though there are no "competing electors, " Gohmert and plaintiffs claimed the Electoral Count Act of 1887 (ECA) violates the Twelfth Amendment by not allowing the VP to count uncertified votes cast by Trump's so-called slate of "shadow electors". He also noted that House GOP leader Kevin McCarthy and GOP Whip Steve Scalise dissented from the House's legal arguments against Gohmert's lawsuit.

I imagine what he's going to do is make a notice about serious irregularities, which we all not is not true, in the counting of the votes in various states, and then he will preside in the way he's supposed to.

"Plaintiffs conclude their Electoral College fantasy by proposing unlimited discretion for defendant Pence to usurp the electoral process as plaintiffs desire", Kennedy, a lawyer, said in a motion to intervene in the case. They say the president of the Senate has "exclusive authority and sole discretion under the 12th Amendment to determine which slates of electors for a state, or neither, may be counted".

It's the latest, and likely last, piece of a desperate effort by President Donald Trump and his allies to cling to power in the face of President-elect Joe Biden's victory. However, seven states have what are known as dueling electors, over two dozen House members said that they will contest the results, and some legal scholars argue that Mike Pence might have the authority to declare President Donald Trump as the victor. In his suit, Gohmert indicates he expects more than 140 members of the House to join in challenging Biden's victory on January 6. It requires Pence to introduce electors alphabetically by state, and it sets out a process for House members and senators to challenge disputed electors. The framers would never have provided for a process that allowed a sitting vice president - often, as in this case, an actual candidate on the Electoral College ballot - to have unilateral authority to choose which electors to count, the House argued. "But these plaintiff's suit is not a proper vehicle for addressing those issues because plaintiffs have sued the wrong defendant".

The judge overseeing the case, U.S. District Judge Jeremy D. Kernodle, is a 2018 Trump appointee to the federal court.
