Prosecutor Wants Expert Analysis of Uber Self-Driving Crash Video

The Maricopa County Attorney, whose jurisdiction includes Tempe, referred the case past year to another office because of a conflict.

Per Quartz, Yavapai County attorney Sheila Sullivan Polk-the official handling the investigation after the Maricopa County attorney's office recused itself for having coordinated an anti-drunk driving campaign with Uber-wrote in a brief letter dated March 4th that her office had found "no basis for criminal liability for the Uber corporation".

Further records from the streaming service Hulu suggested that Ms Vasquez had been streaming the TV show, The Voice, on a phone at the time of the crash. "We therefore recommend that the matter be furthered to the Tempe Police Department to obtain additional evidence", Polk wrote Tuesday.

Uber pulled its self-driving cars out of Arizona the day before the NTSB report was released, eliminating the jobs of about 300 people who served as backup drivers and performed other jobs connected to the vehicles.

The National Transportation Safety Board released a preliminary report in May saying the autonomous driving system on Uber's Volvo XC-90 SUV spotted Herzberg before hitting her, but didn't stop because the system used to automatically apply brakes in potentially unsafe situations had been disabled "to reduce the potential for erratic vehicle behavior". A Yavapai County prosecutor found that Uber is not criminally liable for the crash.

Yavapai County Attorney Polk said she didn't have enough information to decide whether it would be appropriate to charge Vasquez.

Yavapai sent the case back to Maricopa, calling for further expert analysis of the video to determine what the driver should have seen that night.

Uber settled with Herzberg's family a year ago for an undisclosed amount.

As Reuters noted, the National Transportation Safety Board and National Highway Traffic Safety Administration are still investigating and may reach different conclusions about who is to blame.

Smith says he hopes the NTSB's final report on the crash will illuminate more the crash. "According to Uber, emergency braking maneuvers are not enabled while the vehicle is under computer control to reduce the potential for erratic vehicle behavior".

Instead of the system, Uber relies on the human backup driver to intervene.

It was the first known death of a person in America from a self-driving vehicle.

"A auto was damaged almost every other day in February", wrote Robbie Miller in a letter to several Uber executives. He added that accidents were occurring "every 15,000 miles", and that some drivers "appear to not have been properly vetted or trained".

Police called the incident "entirely avoidable". The potential for a corporation to be charged with manslaughter raises multiple issues of novelty and legal first impressions. "And I'm not sure it tells us much about the criminal, much less civil, liability of automated driving developers in future incidents".
